Why do we use your personal data?

Your personal data is processed by Arts Centre BUDA for the following purposes and legal grounds.  In this respect, Arts Centre BUDA may refuse to provide services or goods, or to enter into contracts or perform actions if you do not provide the necessary information.

  • to participate in the activities of Arts Centre BUDA; (implementation agreement)
  • to inform you about practical information or changes, after purchasing a ticket. (implementation agreement)
  • to send newsletters and invitations. (permission of the person concerned and legitimate interest)
  • to inform about the functioning and activities of Arts Centre BUDA (legitimate interest).
  • to obtain subsidization from the government (legal obligation)
  • to comply with tax and social legislation (legal obligation).
  • to be able to assess whether a contract or service can be concluded and implement it correctly
  • use of personal data for direct marketing, so that Arts Centre BUDA can make proposals regarding its activities.

For the above purposes we may request (and store, collect and process) the following personal data from you:

Arts Centre BUDA processes different types of data depending on the purpose. 

It concerns information to identify and contact you (name, date of birth and place, address, identity card, profession, job title, education, customer number, national register number, vehicle number plate, driver’s license, telephone and fax number, e-mail, language, user name, data which you provide spontaneously, company or VAT number, information concerning your presence at events (and photos taken thereof), …). Arts Centre BUDA never requests more data than necessary for one of the above objectives.

With regards to the employees of Arts Centre BUDA, this data is also required for payroll administration purposes.


Security and confidentiality

Only duly authorized persons have access to personal data, and only if those data are relevant within the scope of their professional activities.

For the processing of personal data, Arts Centre BUDA also calls on processing firms who process the data on behalf of Arts Centre BUDA (accounting services, social secretariat, IT suppliers, organizers of events, for example).  These are located in the European Economic Area.  When Arts Centre BUDA calls upon processing firms, data may end up in the countries where the data centres of those processing firms are located.  If the countries concerned do not fall under the agreements of the EU, or if the suppliers are not recognized, then Arts Centre BUDA will amend this by, for example, concluding an agreement that provides the necessary guarantees with the processing firms in questions. The basis for keeping personal data is the legal retention period (often up to ten years after the end of a contract or the performance of a transaction). For the implementation or safeguarding of our rights (for example, as long as a claim is pending), this may be longer, in particular in function of the applicable limitation periods, as appropriate.


Retention period

Arts Centre BUDA does not store personal data longer than necessary for the purpose for which it was provided or required by law, i.e. 5 years.


Your rights regarding your data

As a ‘data subject’, the privacy legislation gives you a number of rights, which Arts Centre BUDA undertakes to duly respect.

If Arts Centre BUDA requests permission for data processing, you can later revoke your permission.

If you wish to access the data Arts Centre BUDA has about you, please let us know. Arts Centre BUDA will give you as complete an overview as possible. It is possible that some personal data from backup files, log, history or archive files are not included in this overview. These data are not part of the normally processed personal data and are not immediately available. They are however removed from these files according to customary processes.

You can view, correct, or delete your data in case of unintentional yet unlawful processing.

You can oppose processing by Arts Centre BUDA on the basis of its legitimate interest. Unless there are compelling grounds for not doing so, BUDA will respond to your request.

Arts Centre BUDA does not use data processing that is fully automated, i.e. without human intervention.

You also have the right to have the data provided by you transferred back to yourself or directly to another party. We may ask you to provide proof of identity before we can comply with the aforementioned requests.


Complaints

Should you have a complaint about the processing of your personal data, we ask you to contact us directly (info@budakortrijk.be).

You always have the right to file a complaint with the Privacy Commission (www.privacycommission.be), this is the supervisory authority in the area of ​​privacy protection.


Photos and videos

If you participate in certain activities, photos may be taken to be used in a descriptive report of the event. These can be spread on our website and social media. If you do not want your photo to be used, you can always let us know via info@buda.be.


Changes of privacy statement

Arts Centre BUDA can change its privacy statement. We will announce any changes to the privacy statement on our website.
